Physical Fitness During the Programme, you will be involved in various team-building activities facilitated by the Excalibur Leadership Group Limited. Certain activities, dependant on the type of Programme enrolled in, maybe physically strenuous. The level of physical exertion in most cases is equal to a jog around the block. If you are comfortable with this level of exertion then you can be a full participant in the activities. If you are not comfortable with this level of exertion or become uncomfortable at any time during any of the activities, please immediately speak to the instructing staff. Risk Assessment All activities have an element of risk. The activities designed by The Excalibur Leadership Group Limited, associates or suppliers are structured to minimise the risk of injury / minimise all risk and make the activities as safe as practicable. Participation is, however, at your own risk, it is, therefore, up to each person to assess whether, or to what extent, you are willing to undertake activities. Once you have been made aware of each activity if you feel uncomfortable about the element of risk you are at liberty to pull out/withdraw and not participate in that activity. If at any point during an activity you become uncomfortable with the level of risk, you are at liberty to withdraw. Please bring your concerns to the attention of the instructing staff. Liability By selecting the "I agree" box that follows, you acknowledge and agree that neither the Excalibur Leadership Group Limited nor any of their providers, associates or suppliers will be liable for any personal injury which you may suffer arising directly or indirectly during the duration of the Programme including but not exclusive of any activities offered as part of that programme, and, you agree to indemnify and hold harmless the Excalibur Leadership Group Limited and any other of the Excalibur Leadership Group Limited providers, associates or suppliers from and against all claims, liabilities, losses, expenses and damages which may arise out of your conduct on the Programme.

Confirmations This application form must be completed and submitted to the Excalibur Leadership Group Limited for your application to be considered for entry onto the Programme. Confirmation of a place will be sent by email along with an invoice for Programme fees. This email and invoice will form a contract between your organisation and Excalibur Leadership Group Limited. By submitting the application you warrant that you are authorised to make this contract on behalf of your organisation. Full payment of the fees is then required within 7 working days in order to secure your place on the nominated Programme. The Excalibur Leadership Promise of Quality Excalibur Leadership Group Limited recognises that the quality of the Programme is dependent on the class size, calibre and diversity of participants. This means that on some occasions it may be necessary to defer applicants to a subsequent Programme in order to achieve the Excalibur Leadership Group Limited promise of quality learning outcomes and development experience. There may be other circumstances beyond Excalibur Leadership Group Limited’s control. Should it be necessary to postpone or cancel a Programme, participants will be offered a place on a replacement or subsequent Programmes at no extra cost. Cancellation Risk Mitigation Last-minute cancellations are costly and disruptive to both participants, organisations and Excalibur Leadership Group Limited. It is impossible for Excalibur Leadership Group Limited to find suitable substitutes without at least 30 working days' notice. The implication of participants pulling out at the last minute incurs non-refundable costs due to Excalibur Leadership Group Limited commitment to instructors, suppliers and venues. We recommend that participants have a "Plan B". This may involve identifying a suitable replacement who can step in if for some unavoidable reason a participant cannot attend. Alternatively, you may choose to arrange your own insurance cover to mitigate the loss of the Programme Fee relating to the above cancellation policy. Cancellations • i) If the cancellation is made 90 working days or more prior to the commencement of the Programme applied for by the participant, a full refund of course fees paid will be given. • ii) If a cancellation is made after 90 working days prior to the commencement of the Programme, Excalibur Leadership Group Limited will accept a substitute participant from the Organisation concerned if he/she has comparable experience and qualifications. No substitute will be permitted if the cancelation is made within 7 working days of the commencement of the Programme. Conditions regarding transfer to the next Programme are stated below in (iii c). • iii) If a substitute is not available of a comparable experience and qualifications; o a. If a cancellation is made within 30 - 90 working days of the nominated Programme start date applied for by the participant and a suitable replacement is not available, 50% of the fees will be refunded. If the fees have not already been paid, then 50% of the fees will be payable within seven working days. o b. If a cancellation is made within 29 working days of the commencement of the nominated Programme start date applied for by the participant and a suitable replacement is not available, then no refund will be made. If the fees have not already been paid, then full fees are payable within 7 working days. o c. If the participant withdraws from the Programme 48 hours prior to the commencement of the Programme due to illness or any other unavoidable emergency, a transfer to the next Programme will be considered. A discount of 50% of the fees for the next programme will be given if the same candidate wishes to attend. The obligations covered in (b) still apply regardless of the transfer. Excalibur Leadership Group Limited retains the right to determine whether a proposed substitute is acceptable. It is not Excalibur Leadership Group Limited’s intention to profit from unavoidable late cancellations and every effort will be made to find a suitable substitute in the case of cancellations. Intellectual Property, Copyright and Non-Solicitation All Programme participants submitting an application with Excalibur Leadership Group Limited acknowledge and recognise that the Excalibur Leadership Group Limited is the exclusive owner of any and all intellectual property which includes copyright, trademarks, business and company names, domain names, design, trade secrets, know-how, confidential and other proprietary rights, logos, symbols, insignia, emblems, telephone numbers, email addresses and all other forms of intellectual property rights in the Programme and in Excalibur Leadership Group Limited materials and processes whether created before or after the date of the application. The Programme offered by Excalibur Leadership Group Limited has been designed for executive development and not as a 'train-the-trainer' course. In submitting the application, the participant accepts Excalibur Leadership Group Limited rights and agrees not to use or copy, whether physically or digitally, Excalibur Leadership Group Limited materials and processes. The participant agrees not to act in a manner (or support others) which would be commercially competitive either directly or indirectly to Excalibur Leadership Group Limited either before or after attending the Programme. Participants agree not to approach and/or solicit staff or contractors of Excalibur Leadership Group Limited either before or after attending the Programme. Confidentiality and Non-Disclosure of Information Please note that the information included in this document and all material provided and presented during the Programme is subject to an obligation of confidence and is commercially sensitive. Further, it would unreasonably prejudice the commercial position of the Excalibur Leadership Group Limited if it was released into the public domain. For this reason, if a request is made for this information under the Official Information Act 1982, we request that Excalibur Leadership Group Limited is consulted before this information is released.
